Section 5’s – Declarations of exempted development Generally, you need planning permission for any development of land or property unless the development is specifically exempted. Exempted development is development for which planning permission is not required. The Planning and Development Act 2000, as amended sets out types of development that are exempted. Categories of exempted development are set out in the Planning and Development Regulations 2001, as amended. The purpose of exemption is to avoid restrictions on minor developments. In accordance with Section 5 of the Planning and Development Act 2000 as amended any person may request a declaration as to whether development is exempt. An application should be made in writing to the planning authority, to determine whether a proposal requires permission or is considered exempted development. There were 4 section 5 applications received in November 2021 and 7 completed. 68 applications were received in January to November 2021 compared 58 being received for the same period last year.
